Many small and medium-sized business owners are unaware of their obligation to submit a Workplace Skills Plan (WSP) to their relevant Sector Education and Training Authority (SETA) each April or an Employment Equity Plan to the Department of Labour every October. It is often assumed that bookkeepers handle these submissions, but in reality, most do not. As a result, many businesses unknowingly expose themselves to potential fines and spot inspections by the Department of Labour.

Skills Development Facilitation

Any company who has salaries of more than R 500 000 per year must submit a WSP (Workplace Skills Plan) and ATR (Annual Training Report) to their SETA (Sectorial Education and Training Authority) by the 30th of April every year.

Employment Equity Plans

Any company who has 50 or more employees must submit an EEP (Employment Equity Plan) by the 1st working day of October of every year or face a fine of R 1 500 000 for non-compliance.

Who Must Submit a WSP?

All businesses with an annual payroll of R500,000 or more must pay the Skills Development Levy (SDL) and are encouraged to submit a WSP. A registered Skills Development Facilitator (SDF) is typically responsible for preparing and submitting the WSP.

Purpose of a WSP
  • Identifies skills gaps and training needs within the organization.
  • Ensures that training aligns with industry requirements and national skills development goals.
  • Enables businesses to apply for Mandatory Grants from their SETA, helping them recover a portion of their Skills Development Levy (SDL).
  • Supports employee growth and career development.

Annual Training Report

Who Must Submit an ATR?

Businesses that pay the Skills Development Levy (SDL) (i.e., those with an annual payroll exceeding R500,000). A Skills Development Facilitator (SDF) usually compiles and submits the ATR.

Purpose of an ATR
  • Demonstrates that the company has implemented the training planned in the Workplace Skills Plan (WSP).
  • Ensures compliance with SETA requirements and the Skills Development Act.
  • Allows businesses to qualify for Mandatory Grants, helping them recover a portion of the Skills Development Levy (SDL) they have paid.
  • Supports broader skills development initiatives and B-BBEE compliance.

Employment Equity Plan

Who Must Submit an EE Plan?

The recent amendments have eliminated the turnover criterion, stipulating that only employers with more than 50 employees qualify as designated employers.

Purpose of an EE Plan
  • Ensures fair representation of designated groups at all occupational levels.
  • Addresses and eliminates unfair discrimination in the workplace.
  • Helps businesses comply with the Employment Equity Act (EEA) and avoid penalties.
  • Contributes to B-BBEE compliance, affecting government contracts and business opportunities.
